FreshNSave – Terms & Conditions

Welcome to FreshNSave! These Terms & Conditions govern your use of the FreshNSave mobile application, whether on Android or iOS, and the services offered via the App by FreshNSave. By downloading, installing, or using the App, or placing orders via the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App or the Services.

1. Definitions

  • User / You / Your: a person who uses the App or places orders for products or services via the App.
  • Services: includes browsing, ordering, purchasing, delivery, and any other features offered via the App.
  • Products: goods, including fresh produce, fish, seasonal fruits, etc., made available for sale on the App.
  • Content: text, images, graphics, logos, audio, video, or other materials displayed in the App.
  • Agreement: these Terms & Conditions.

2. Eligibility & Account Registration

  1. You must be at least 18 years old to use the App and to enter into this Agreement.
  2. You agree to provide true, accurate, current, and complete information when creating an account and to maintain and promptly update your account information.
  3. You are responsible for maintaining the confidentiality of your account credentials (username, password). You agree to accept responsibility for all activities that occur under your account.
  4. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

3. Use of the App & Services

  1. You agree to use the App and Services only for lawful purposes and in compliance with these Terms.
  2. You agree not to:
    a. Use the App in any way that violates applicable laws or regulations.
    b. Use the App in a way to infringe the rights (intellectual property, privacy, etc.) of others.
    c. Use any automated means (bots, scrapers) to access or use the App.
    d. Interfere with, disrupt, or attempt to gain unauthorized access to systems or networks connected to the App.
    e. Transmit any malware, harmful code, or any content that is unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable.

4. Products, Orders & Payments

  1. All orders placed through the App are subject to acceptance by us, and we may refuse or cancel any order for any reason.
  2. Prices, offers, and availability of Products may change without prior notice.
  3. Payment must be made via the payment methods we provide (e.g. credit/debit card, digital wallets). By providing payment information, you represent and warrant that you are authorized to use the payment method.
  4. You agree to pay all charges incurred, including applicable taxes, shipping, delivery, and any other fees.
  5. In case of errors (e.g. incorrect price), we reserve the right to correct those errors or cancel orders.

5. Delivery & Returns

  1. We will attempt to deliver the Products to the address you provide.
  2. You agree to provide accurate delivery information (address, contact).
  3. Delivery times are estimates and not guaranteed.
  4. If you are unavailable to receive delivery, we may leave it at your doorstep or reschedule, as per policy.
  5. You may inspect Products at delivery. If a Product is damaged or defective, you should report it immediately. We may offer replacements, refunds, or credits as per our refund/return policy.

6. Refunds, Returns & Cancellations

  1. Cancellation policies: Orders may be canceled before being processed/shipped (as per our policy).
  2. Returns/refunds: If eligible, refunds will be processed per policy (to original payment mode) within a reasonable time.
  3. We reserve the right to decline returns or refunds if Products have been used, altered, or are perishable (unless defective).

7. Intellectual Property Rights

  1. All content, trademarks, logos, designs, and software in the App are owned or licensed by FreshNSave or its licensors.
  2. You may use the App and view content for your personal, non-commercial use only.
  3. You must not copy, reproduce, republish, upload, post, transmit, or distribute any content from the App without express prior written permission.

8. Privacy & Data

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and share your personal information. By using the App, you consent to that collection and processing.

9. Disclaimers & Limitation of Liability

  1. THE APP AND SERVICES ARE PROVIDED “AS IS,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
  2. We do not warrant that the App will be error-free, secure, or uninterrupted.
  3. To the maximum extent permitted by law, FreshNSave and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising from your use of the App or Services.
  4. Our aggregate liability to you (for any cause) will not exceed the amount you have paid to us in respect of the relevant order in the last 12 months (or another limit as per law).

10. Indemnification

You agree to indemnify, defend, and hold harmless FreshNSave and its affiliates, officers, agents, partners, and employees from any loss, liability, claim, or demand (including reasonable legal fees) made by any third party due to or arising from your use of the App, your violation of these Terms, or your infringement of any rights.

11. Termination

  1. We may terminate or suspend your access to the App at any time, without notice or liability, for any reason (e.g. breach of Terms).
  2. Upon termination, all rights granted to you under these Terms will immediately cease, and you must stop using the App.
  3. Sections that by their nature should survive termination shall do so (e.g. intellectual property, disclaimers, limitation of liability, indemnification).

12. Modifications to Terms

We may revise or update these Terms from time to time. When we do, we will post the new version in the App or on our website, and update the “Last Updated” date. Your continued use of the App after changes implies your acceptance of those changes. If you do not agree, you must stop using the App.

13. Governing Law & Dispute Resolution

  1. These Terms shall be governed by and construed in accordance with the laws of India and the applicable state law (Kerala, if applicable), without regard to conflict of law principles.
  2. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in [City, Kerala (or other location as appropriate)].
  3. Before initiating legal action, you agree to first attempt to resolve any dispute with us via good-faith negotiations or through our customer support.

14. Miscellaneous

  1. Entire Agreement: These Terms (and any policies referenced herein) constitute the entire agreement between you and FreshNSave relating to the App and supersede all prior agreements or understandings.
  2. Severability: If any provision is found invalid or unenforceable, the remaining provisions will remain in effect.
  3. Waiver: Our failure to enforce any right does not constitute a waiver of that right.
  4. Assignment: You may not assign your rights or obligations under these Terms without our prior written consent; we may assign freely.
